Civil case - Federal Railroad law. District court erred in finding
common law claims that defendant did not properly test urine samples
and reported inaccurate test results to plaintiff's employer were
preempted by federal law, as the drug testing regulations the Secretary of
Transportation has adopted through the Federal Railroad Administration
do not preempt common law negligence claims; Congress has not
completely preempted state law causes of action in this area, and the
district court erred in removing plaintiff Howell's action to federal court.
