041696P.pdf 05/03/2006 Gary Lefkowitz v. United States
U.S. Court of Appeals Case No: 04-1696
   District of Minnesota
[PUBLISHED] [Loken, Author, with Hansen and Bye, Circuit Judges]
Prisoner case - habeas. Claim that this court's refusal to approve application for $300,000 for accounting experts amounted to court- induced ineffective assistance of counsel was not raised on direct appeal and was procedurally defaulted; even if the claim was not procedurally defaulted, it failed on the merits because any shortage in funds for the defense was the result of Lefkowitz's failure to pay for his defense from his own funds; neither Booker nor Blakely apply to movants in collateral proceedings.
