Trustee brought negligence action against the American Shorthorn Association and its executive secretary and treasurer alleging breach of duty of care to the debtor investment partnerships, and appeals the district court's adverse grant of summary judgment. Under sole actor doctrine, which applies to state jurisdictions involved as an exception to the adverse interest rule, the negligence action against the two defendants is barred by the doctrine of in pari delicto.
