U.S. Court of Appeals Case No: 04-3109
District of Minnesota
[PUBLISHED] [Colloton, Author, with Wollman and Hansen, Circuit
Judges]
Criminal Case - conviction. Defendant, who is a felon, failed to present
sufficient evidence to support two elements of legal justification defense
for possessing a firearm and thus district court did not err in denying
justification instruction. Must show real and specific threat existed at the
time of the unlawful possession and that there was no other reasonable,
legal alternative, neither of which was satisfied. Theft from a person
qualifies as a predicate offense under Armed Career Criminal Act. Other
claims without merit.
