Civil case - civil rights. Residency restrictions in Arkansas's sex
offender registration statute do not infringe on a fundamental right,
and the statute is not subject to strict scrutiny; the restrictions
rationally advance some legitimate governmental purpose and are
constitutional; restrictions are not so punitive in purpose or effect
as to negate the state legislature's intent to create a civil,
non-punitive regulatory scheme; procedural due process challenge to
risk assessment process rejected, as the statute and implementing
guidelines give offenders notice of the risk assessment process and
provides them a meaningful opportunity to be heard.
