U.S. Court of Appeals Case No: 05-2650
Western District of Missouri
[PUBLISHED] [Colloton, Author, with John R. Gibson and Gruender,
Circuit Judges]
Prisoner case - prisoner civil rights. While the district court gave a
factually correct answer to the jury's question about whether there were
past inmate complaints against defendant, the question was irrelevant to
the issue before the jury and the court should have informed the jury that
the question was irrelevant; there is a reasonable likelihood that the
district court's response confused the jury regarding the burden of proof
in the case, and the matter must be remanded for a new trial.
