U.S. Court of Appeals Case No: 05-4180
   Eastern District of Missouri
[PUBLISHED] [Arnold, Author, with Beam, Circuit Judge and Doty, District
   Judge]
Criminal Case - conviction and sentence. Testimony of coconspirators
and as admission of party were properly admitted; admission of prior
conviction was proper because defendant had been released from
confinement less than ten years before current indictment; even if time
should be calculated from date of conviction or release to date of trial,
admission was not error because defendant addressed prior conviction on
direct examination. Defendant was denied right to cross-examine witness
about alleged threat made during break in trial but error was harmless
beyond a reasonable doubt. Evidence was sufficient to support
convictions. District court's statement regarding sentence showed district
court was fully aware of responsibility to consider sentencing factors and
sentence was not unreasonable in light of co-defendant's sentences.
