U.S. Court of Appeals Case No: 06-3783
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Colloton, Author, with Chief Judge Loken and Arnold,
Circuit Judges]
Civil Case - ERISA. Termination of disability benefits is reviewed for
abuse of discretion and district court did not err in concluding the
administrator did not abuse its discretion in terminating benefits, as
evidence showed employee was able to work. Determination that
employee was not disabled is supported by substantial evidence. District
court did not abuse its discretion in refusing to compel discovery.
