U.S. Court of Appeals Case No: 07-2814
U.S. District Court for the Eastern District of Missouri - Hannibal
[PUBLISHED] [Colloton, Author, with Murphy and Shepherd, Circuit Judges]
Prisoner case - prisoner civil rights. Without any admissible evidence
that defendant Dr. Carter was informed of plaintiff's serious medical
condition, there was no basis for an Eight Amendment claim against him,
and the district court did not err in granting his motion for summary
judgment; district court did not err in denying plaintiff's motion for
judgment as a matter of law against defendant Carter, the prison unit
manager, as a reasonable juror could have chosen to believe Carter's
testimony that the risk of inaction on his part was insubstantial or
nonexistent because plaintiff could have received emergency medical
care without Carter's approval or action; plaintiff failed to create a
disputed issue of material fact with respect to whether the Department of
Corrections accommodations gave him meaningful access to prison
benefits involving reading and writing.
