U.S. Court of Appeals Case No: 07-3207
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Melloy, Author, with Loken, Chief Judge, and John R.
   Gibson, Circuit Judge]
Criminal case - criminal law and sentencing. Defendant's conditional
guilty plea foreclosed defendant's challenges to his arrest and the
seizure of evidence related to his offense; the affidavits supplied in
support of the warrant for the search of defendant's apartment
established probable cause to believe police would seize evidence of
child pornography; life sentence was within the statutory range authorized
by Congress for child pornography offenses and is not cruel and unusual
punishment; sentence was not disproportionate considering the severity of
   defendant's crimes and his recidivism.
