Criminal Cases - conviction and sentence. Convictions and sentences
for filing false tax returns are affirmed. Claim prosecutor and IRS
mislead grand jury is harmless error. District court did not err in
instructing jury, in denying recusal, in denying motion for acquittal, in
denying motion for mistrial, or in admitting evidence. Sufficient
evidence supported verdict. Advice to third party was relevant conduct
and supported use of third-party tax losses in calculating sentence.
Hearsay testimony met required indicia of reliability.
