U.S. Court of Appeals Case No: 09-2417
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Colloton, Author, with Smith, Circuit Judge, and
   Kornmann, District Judge]
Civil case - civil rights. Evidence supported the jury's verdict that
defendants were not deliberately indifferent to plaintiff's medical needs
while he was held as a pre-trial detainee at the Johnson County Jail as a
reasonable jury could find that plaintiff did not show that a doctor or
other medical personnel had diagnosed him with a medical condition that
required treatment; district court did not err in refusing to instruct the
jury that the lack of clean air in the jail created an unjustifiable risk to
plaintiff's future health as plaintiff failed to challenge his conditions of
confinement based on a risk of future injury that was distinct from the
current medical need that he allegedly endured while incarcerated.
