U.S. Court of Appeals Case No: 09-3082
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Colloton, Author, with Wollman and Ebel, Circuit Judges]
Civil case - employment discrimination. A jury instruction on whether
discrimination was a motivating factor in plaintiff's termination was a
correct statement of the law under the Iowa Civil Rights Act; the jury's
award of damages is supported by the finding of liability under the Iowa
Civil Rights Act and the fact that the instruction is an incorrect statement
of law under the ADEA did not prejudice defendant; award of attorneys'
fees affirmed.
