Criminal case - Criminal law and Sentencing. District court did not err
in concluding defendant was not in custody at the time he made certain
statements and that the statements were voluntary and admissible; record
supported the district court's conclusion that defendant voluntarily
consented to a search of his home; defendant's waiver of his Miranda
rights was knowing, voluntary and intelligent and his post-arrest
statements were admissible; state court conviction for second-degree
assault was a crime of violence for sentencing purposes; the district court
did not commit any procedural error in determining defendant's sentence
and the sentence imposed was not substantively unreasonable.
