U.S. Court of Appeals Case No: 09-3545
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Colloton, Author, with Wollman and Ebel, Circuit
Judges]
Criminal case - criminal law. Warrant application gave the issuing
magistrate a substantial basis to conclude that evidence of a firearms
offense would be found in the house named in the warrant; assuming the
warrant application was technically deficient for failing to identify the
basis for the assertion that defendant possessed the house, the officers
acted in good-faith reliance on the warrant, and the evidence seized
during the search was admissible under Leon; search warrant described
the place to be searched with sufficient particularity.
