U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED][Colloton, Author, with Riley, Chief Judge, and Benton,
Circuit Judges]
Criminal case -criminal law and sentencing. Police had probable cause
to believe defendant's vehicle contained methamphetamine, and evidence
seized during the warrantless search of the car was admissible under the
automobile exception; evidence was sufficient to support defendant's
conviction for conspiracy to distribute methamphetamine and possession
of the drug with intent to distribute; brief jury deliberation is not a
sufficient basis for a new trial; defendant failed to meet his burden of
proof for safety-valve sentencing.
