Civil case - Employment discrimination. With respect to plaintiff's claims
that UPS retaliated against him by demoting him for protected activity, he
conceded that neither of the decision-makers were aware of the activities
and there was, therefore, no causal link between the activities and the
demotion; with respect to plaintiff's race discrimination claim, the claim
would be analyzed under the McDonnell Douglas framework and failed at the
third step, because UPS provided a legitimate, non-discriminatory basis
for the action, which plaintiff failed to show was a pretext for
discrimination.
