U.S. Court of Appeals Case No: 19-1375
U.S. District Court for the District of South Dakota - Sioux Falls
[PUBLISHED] [Kobes, Author, and Erickson and Grasz, Circuit Judges]
Criminal case - Criminal law and sentencing. The district court did not
err in refusing to admit a statement made by defendant's late girlfriend,
as it was hearsay and did not meet the first requirement of Rule 807 -
that the statement have the necessary circumstantial guarantees of
trustworthiness; the district court did not err in imposing an enhancement
under Guidelines Sec. 3C1.1 based on its determination that defendant
committed perjury; the imposition of such an enhancement does not violate
a defendant's constitutional right to testify in his own defense as that
right does not include a right to commit perjury; defendant's sentence was
substantively reasonable.
