U.S. Court of Appeals Case No: 19-1713
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Smith, Author, with Colloton and Stras, Circuit Judges]
Civil case - In this action alleging defendants arrested plaintiff without
probable cause, the evidence, viewed in the light most favorable to
plaintiff, would support a finding that the two arresting officers
violated plaintiff's clearly established right to be free from
unreasonable seizure without probable cause, and the district court erred
in granting the two arresting officers summary judgment based on qualified
immunity; no officer could have believed probable cause to arrest
plaintiff existed based on the plainly exculpatory evidence available to
them; the grant of summary judgment to the remaining defendants is
affirmed; remanded for further proceedings. Judge Colloton, concurring.
Judge Stras, concurring in part and dissenting in part.
