U.S. Court of Appeals Case No: 19-2166
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Kobes, Author, with Kelly and Melloy, Circuit Judges]
Civil case - ERISA. The district court did not err in determining the plan
committee did not breach its fiduciary duty by failing to review
plaintiff's medical records after it determined plaintiff's claim was
untimely; the committee consistently took the position that the
application was denied as untimely because it was not made before or in
connection with plaintiff's separation, and there was no impermissible
difference between the rationale stated in defendant's denial letters and
its litigation position.
