U.S. Court of Appeals Case No: 19-3173
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Kobes, Author, with Gruender and Wollman, Circuit Judges]
Criminal case - Sentencing. The district court understood its authority
and discretion under the First Step Act; a district court may, but need
not, consider the 3553(a) factors in deciding a First Step sentence
modification; the court met its obligation to conduct a complete review of
the First Step motion by considering the motion and stating a reasoned
basis for its decision; there is neither a constitutional nor statutory
right to counsel in First Step proceedings; the district court did not
abuse its discretion by declining to appoint counsel.
