U.S. Court of Appeals Case No: 20-2071
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Kobes, Author, with Shepherd and Erickson, Circuit Judges]
Criminal Case - Suppression. During the execution of a search warrant that
included locked containers, safes, hidden compartments, officers found
Simmermaker asleep on the couch with a Brink's security lockbox nearby,
which contained drugs and a digital scale. Simmermaker's motion to
suppress was denied. Simmermaker's presence near the contraband gave
officers particularized suspicion that she was connected to the illicit
activity and the box was subject to the warrant as a locked container.
