U.S. Court of Appeals Case No: 21-1241
U.S. District Court for the Southern District of Iowa - Western
[PUBLISHED] [Kobes, Author, with Colloton and Grasz, Circuit Judges]
Criminal case - Criminal law and sentencing. Defendant was speeding, and
the police office had probable cause to make a traffic stop; the officer
had authority to ask defendant to get our of her car during the stop; the
stop was not unreasonably extended under the facts presented; the district
court did not err in finding that defendant and her passenger voluntarily
consented to a search of their rental car, and the 28.4 pounds of heroin
found in the trunk was admissible; the district court did not clearly err
in denying defendant safety-valve sentencing on this record; the district
court sentenced defendant to the mandatory minimum and her argument that
the court should have given her a minor-role reduction could not result in
any relief.
