U.S. Court of Appeals Case No: 21-2033
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Kobes, Author, with Colloton and Kelly, Circuit Judges]
Criminal case - Criminal law and sentencing. The district court did not
err in denying defendant's motion for a new trial based on violation of
the witness sequestration order as the record simply does not support a
claim that defendant was injured by an undefined discussion; because the
evidence in question was immaterial to the outcome of the case, the
government's failure to disclose a DEA affidavit was not a Brady
violation; defendant's sentence was substantively reasonable.
