Civil case - Commerce Clause. In an action brought by an out-of-state
trash collector challenging a county ordinance requiring all refuse
haulers to deposit their collections at a government-owned facility so
that it could be converted into refuse-derived fuel for use at a power
plant, the district court did not err in granting defendant summary
judgment, as the ordinance did not implicate the dormant Commerce Clause.
