[PUBLISHED] [Before Grasz, Stras, and Kobes, Circuit Judges] Civil case - Rehabilitation Act. Plaintiff's requested accommodation, exemption from rotating night and day shifts, was not required under the Act because it would impose an undue hardship on his employer; the accommodation would have violated the employer's collective bargaining agreement with plaintiff's union and was, therefore, presumptively unreasonable; plaintiff's reassignment to a job with stable shift assignments was reasonable in light of the fact that he could not be accommodated in his prior position; plaintiff failed to show the employer did not engage in the interactive process required by the Act; with respect to the employer's failure to hire plaintiff for other positions, defendant provided a legitimate, non-discriminatory basis for its hiring decisions, which plaintiff failed to show was pretextual.
