[PUBLISHED] [Kobes, Author, with Loken and Arnold, Circuit Judges] Civil case - Civil rights. Plaintiff, a police officer, sent a video to an officers' text group critical of the Black Lives Matter protests and then was forced to resign his position. Held: The video expressed a message unrelated to plaintiff's official duties; the speech, which commented critically on the Black Lives Matter movement and press coverage of police shootings, involved a matter of public concern; considering the content, form and context of the speech, plaintiff's complaint stated a claim for First Amendment retaliation, and the district court erred in dismissing the complaint. Judge Loken, concurring.
