U.S. Court of Appeals Case No: 22-1315
U.S. District Court for the District of Minnesota
[PUBLISHED] [Kobes, Author, with Kelly and Wollman, Circuit Judges]
Civil case - Civil rights. In action where the parents of students killed
in a car crash alleged that defendant Eichens, a Minnesota state trooper,
violated their constitutional rights by conducting a flawed investigation
in order to protect the defendant school and that the school and other
defendants conspired to obstruct justice in the parents' earlier state
court wrongful death case, the district court did not err in finding that
collateral estoppel barred the Section 1983 claim against the trooper;
assuming plaintiff's Section 1985(2) conspiracy claim survives collateral
estoppel, the claim failed on the merits because plaintiff could not show
the alleged conspirators were motivated by a class-based invidiously
discriminatory animus. Judge Kelly, concurring in part and concurring in
the judgment.
