Criminal Case. Government's interlocutory appeal of grant of
motion to suppress for failure to disclose expert witness.
Government's certification that evidence is material is sufficient
to support jurisdiction. Although government broke its promise
to supply discovery, district court abused its discretion in striking
expert testimony without establishing prejudice and court should
have chosen less severe sanction. District court's order granting
suppression motion is reversed.
