Civil Case - state habeas corpus. Defendant was convicted of
forcible sodomy. District court's denial of habeas petition is
affirmed. District court properly concluded state court did
not apply test for ineffective assistance of counsel unreasonably
when it determined defendant was not prejudiced by counsel's
failure to present prior inconsistent statements of victim and
witness. Objection to state court's conclusion that defendant
had waived objection to jury instruction was barred and defendant
failed to show sufficient prejudice to excuse procedural default.
Defendant failed to show prejudice from counsel's failure to
object to the instruction.
