U.S. Court of Appeals Case No: 00-1202
District of Minnesota
Criminal Case. Conviction for being a felon in possession of firearms
is affirmed. District court did not abuse its discretion in denying
change of venue based on pretrial publicity, as a presumption of
inherent prejudice was not established and district court took
precautions in assembling jury pool. District court did not err in
refusing to strike juror for cause. District court did not err in
denying defendant's motion to suppress ammunition seized; no
plain error in searching home in Richfield and second search
warrant was supported by probable cause; seizure of ammunition
was proper as contraband fell within the plain view exception
and officers who conducted search knew ammunition was linked
to criminal activity.
