any part of his tort action against the U.S. on claims which
were not first presented to the proper administrative agency; as
plaintiff did not plead a continuous treatment theory of
negligence in his administrative claim, he cannot raise the
claim in his tort action or toll the applicable statute of
limitations by use of the theory; dissent by Judge Theodore
