U.S. Court of Appeals Case No: 00-1465
Western District of Missouri
Civil case - civil rights. Plaintiff's depression was not an impairment
which substantially limited her ability to perform a major life activity;
plaintiff failed to produce sufficient evidence to create a jury issue as
to whether Olin regarded her as disabled; under the Family Medical
Leave Act, restoration of pay, title and benefits does not necessarily
constitute restoration to the same position if the job duties and
essential functions of the newly assigned position are materially
different; case remanded for further proceedings on whether plaintiff's
new assignment was an equivalent position under the Act.
