Criminal case. Conviction for conspiring to distribute cocaine
and cocaine base is affirmed. District court did not err in refusing to
suppress evidence based on misquotation in search warrant; court did not
abuse its discretion in denying a Franks hearing. No plain error in
admitting officer's testimony alleged to have been hearsay. Sentence
of coconspirator is also affirmed. Although district court clearly
erred in attributing drug quantity to Randy Anderson, the error was
harmless, considering there was ample evidence to support sentence
enhancements and resulting guidelines range would have been the
same absent calculation errors. Inclusion of 1994 and 1996 events
was properly construed as relevant conduct.
