   Civil Case - state habeas corpus. District court's dismissal of habeas 
   relief because state court held ineffective assistance claim was 
   procedurally defaulted is affirmed. Minnesota consistently applies 
   state rule and federal court will not review issue that state court has 
   found to be defaulted on adequate and independent state law basis. 
   Judge Bye concurs and Judge Bright dissents.
