U.S. Court of Appeals Case No: 00-1931
and No: 00-1941
Eastern District of Arkansas
Criminal Case. Defendant's conviction for being a felon in
possession of firearm is affirmed and sentence is vacated.
Search warrant was supported by probable cause because
storage of items common to methamphetamine production
raised sufficient suspicion of criminal activity; district court
did not abuse its discretion by refusing to exclude under Rule 403
rebuttal testimony regarding the number of beds in the house;
and there was sufficient evidence to support the conviction.
District court erred in failing to count prior escape conviction
as a crime of violence.
