U.S. Court of Appeals Case No: 00-2584
Western District of Arkansas
Criminal case - criminal law. Defendant lacked a reasonable expectation
of privacy in motel room rented by companion; defendant consented to
pat-down search and fruits of search were admissible; because agents
had grounds for defendant's arrest, two hour detention while officers
waited for drug dog to search the motel room was not unconstitutional;
record supported trial court's finding that the drug seized was crack;
defendant was not prejudiced, under plain error review, when Guidelines
Section 5G1.2(d) would render his sentence identical after remand to
correct Apprendi error.
