U.S. Court of Appeals Case No: 00-2669
and No: 00-2704
Eastern District of Arkansas
Civil case - insurance. Plaintiff failed to prove unidentified truck
which forced her off the road was uninsured for purposes of Arkansas
law and her insurance policy; applicable Arkansas statute does not
create a presumption that unidentified vehicle is uninsured; to be
eligible under hit-and-run provision of the policy, plaintiff must
establish physical contact with the other vehicle, and near-hit or
miss-and-run does not invoke coverage.
