U.S. Court of Appeals Case No: 00-2764
Western District of Missouri
Prisoner case - habeas. Imposition of same sentence for fewer
counts of conviction after Sexton successfully appeal his
initial conviction did not violate North Carolina v. Pearce,
395 U.S. 711 (1969); evidence of sodomy was constitutionally
sufficient; limitations on cross-examination of minor victim
were not a denial of Sexton's Confrontation Clause rights;
ineffective assistance of counsel claims were procedurally
defaulted. Dissent by Judge Richard S. Arnold on the Pearce issue.
