U.S. Court of Appeals Case No: 00-2909
District of South Dakota
Criminal case - Sentencing Guidelines. Given brutal and inhumane
method in which defendant stalked and killed his parents, burned
their bodies and exposed a six-year-old to the offense, district court
did not err in imposing upward departure for cruel, heinous and brutal
conduct; defendant was not entitled to downward departure based on
claim of mental illness under the Guideline used to enhance his sentence
for brutal conduct; court could impose consecutive sentence for firearm
offense.
