U.S. Court of Appeals Case No: 00-3243
Eastern District of Missouri
Civil case - employment law. Under Missouri law, inclusion of
invalid provision in employment contract did not render the
entire contract invalid; the invalid clause - a punitive damages
provision - did not invalidate the whole contract on public policy
grounds; severance of invalid provision did not diminish
plaintiff's contractual intent to arbitrate her claims against
employer, as the severing of the clause places her in a better
position than that to which she agreed when she accepted
employment; case remanded for arbitration of claims;
dissent by District Judge Vietor.
