Civil case - Civil rights. No reasonable juror could have found
defendant's remedial actions taken in response to plaintiff's
complaint regarding an offensive photo to be anything but
prompt and reasonably calculated to end the harassment;
plaintiff failed to create a genuine issue of material fact as
to whether the harassment affected a term, condition or
privilege of employment; plaintiff also failed to create a
genuine issue of material fact as to whether the continuing
rumors concerning the photo constituted harassment that
was so offensive, intimidating or hostile that it poisoned the
work environment and created a hostile work environment;
plaintiff failed to establish that defendant's action in placing
her on performance improvement plan was in retaliation for
her complaint.
