and No: 00-3448
Southern District of Iowa
Civil case - civil rights. Plaintiff's evidence was sufficient
to establish hostile work environment and sexual harassment;
evidence showing management did nothing to man accused
of harassment despite the fact that the responsible manager
thought plaintiff's allegations were credible was sufficient
to support an award of punitive damages; defendant's
judgment on constructive discharge claim affirmed; under
Iowa law, battery claim was not within the exclusive jurisdiction
of workers' compensation system; district court erred in
resubmitting battery claim to the jury based on a mistaken belief
that an award of compensatory damages was prerequisite for an
award of punitive damages for battery; battery award remanded
for entry of a judgment giving effect to the original verdict on the
claim.
