U.S. Court of Appeals Case No: 00-3534
Western District of Missouri
Civil case - contracts. Given that plaintiff was an employee-at-will
and his employment contract did not guarantee that he could
maximize his incentive awards, defendant did not breach
plaintiff's employment contract when it sold its business
thereby preventing him from reaching certain performance
goals which would have triggered the awards; severance pay
was properly calculated under the employment contract;
plaintiff was not owed attorneys' fees under the contract;
Missouri law precluded plaintiff from recovering the
benefit-of-the-bargain damages he sought for alleged
negligent misrepresentations.
