Civil Case - arbitration. Delta Mine Holding Company sought to
terminate its lease with AFC Coal Properties, Inc. and two arbitration
proceedings followed. The district court erred in vacated both awards
based on misconduct of Delta Mine's selected arbitrator, as AFC
waived objection to arbitration panel, partisan arbitrators are permissible,
and AFC failed to show partiality prejudiced the award. AFC also
failed to show arbitrator's use of undue means and misbehavior influenced
the outcome of the arbitration. Objections to consolidation of
arbitrations are without merit.
