U.S. Court of Appeals Case No: 00-3664
Eastern District of Missouri
Civil case - Qui tam. After relators' bankruptcy became final, their
qui tam claim became as asset of the bankruptcy state, and relators
no longer had standing to bring the qui tam suit; settlement
agreement and release between relators and defendants were
enforceable; district court did not err in applying principles
of judicial estoppel to bar claim in light of relators' failure to
list the claim on their bankruptcy schedules.
