Civil Case - qualified immunity. Fire officials are not entitled to
summary judgment on the basis of qualified immunity for civil
rights action alleging Assistant Fire Chief was demoted and
then terminated for exercising his First Amendment rights.
Fire officials did not show the speech in question had led or
would lead to disruption in the department. Denial of summary
judgment based on liability of one director who voted against
the demotion is reversed.
