U.S. Court of Appeals Case No: 00-3998
District of South Dakota
Civil case - Indian law. Under the plain meaning of the Indian
Child Protection and Family Violence Prevention Act,
plaintiff's conviction for a crime of violence is an absolute
bar to employment in a position that involves regular
contact with Indian children, and fact that it was set aside
under the Federal Youth Corrections Act does not remove
him from the Act's prohibition.
