U.S. Court of Appeals Case No: 00-6089
and No: 00-6104
Northern District of Iowa
Bankruptcy Appellate Panel. Bank's mortgages were unenforceable
under Iowa law because the bank failed to insert the homestead
waiver provision required by Iowa Code Section 561.22; finding that
the plan was feasible under Section 1325(a)(6) was not clearly
erroneous because the record established debtor's father would help
make a balloon payment.
