U.S. Court of Appeals Case No: 01-1066
Northern District of Iowa
Civil case - ERISA. Severance agreement waived rights to short-term
disability benefits; because ERISA contains no statute of limitations,
district court did not err in applying statute of limitations found in
Iowa Wage Payment Collection Act, the most analogous state statute;
defendant did not breach duty to provide plaintiff with a plan summary
as he was not a participant in the plan after his severance.
